By accessing or using our services, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
Use License
Permission is granted to temporarily use our services for personal, non-commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not modify, copy, distribute, transmit, display, perform, reproduce, or publish any information from our services.
User Accounts
To access certain features of our services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Intellectual Property
Our services and their original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use our trademarks without our prior written consent.
User Content
By submitting content or connecting third-party services to MailerProfit, you grant us a worldwide, non-exclusive, royalty-free license necessary to operate and improve the service. You represent and warrant that you own or have the necessary rights to any content you submit and the authority to connect any third-party accounts.
Payments, Subscriptions, and Refunds
MailerProfit offers both subscription-based access and one-time purchases for digital content. All payments are processed through a third-party payment processor (MamoPay). By providing payment information, you agree to their terms. DUE TO THE DIGITAL NATURE OF OUR SERVICES, ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE, INCLUDING BOTH SUBSCRIPTION FEES AND ONE-TIME PURCHASES. Subscription services provide ongoing access to our platform and content library. One-time purchases provide permanent access to specific content without recurring billing. You are responsible for managing your subscription, including cancellations, which can be done through your user profile settings or by emailing us at support@mailerprofit.io.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MailerProfit, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.
Termination
We may terminate or suspend your account and bar access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.
Governing Law
These Terms shall be governed and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
